Pre-nuptial and post-nuptial agreements have been very much in the news recently, with the Supreme Court decision in Radmacher v Granatino  UKSC 42 and the Law Commission’s new consultation paper on Marital Property Agreements prompting debate over the extent to which the law should recognise such agreements.
In this public lecture, Professor Elizabeth Cooke will outline the questions raised in the Law Commission’s consultation. The Law Commission invites comment and discussion on its proposals, which will remain open for consultation until 11 April 2011.
